Terms of Service

Effective Date: July 19, 2026

These Terms of Service govern your access to and use of AikenSCPlumbers.com, including its directory listings, quote-request forms, service-request forms, communications, booking features, reviews, and related services.

AikenSCPlumbers.com is operated by [LEGAL BUSINESS NAME], doing business as Aiken SC Plumbers, referred to in these Terms as “Aiken SC Plumbers,” “Company,” “we,” “us,” or “our.”

By accessing the website, submitting a service request, requesting a quote, contacting a listed provider, booking plumbing work, submitting a review, claiming a listing, or otherwise using the website, you agree to these Terms and our Privacy Policy.

Do not use the website if you do not agree to these Terms.

1. Our Website and Business Model

Aiken SC Plumbers operates a commercial plumbing directory, lead-generation website, referral service, and plumbing-service coordination business serving Aiken, South Carolina, and surrounding areas.

Depending on the circumstances, we may:

  • Publish profiles or information concerning local plumbers and plumbing companies.
  • Collect customer inquiries and plumbing-service requests.
  • Match customers with local plumbers, plumbing companies, or other service providers.
  • Sell, license, assign, distribute, or otherwise transfer customer leads to selected local providers.
  • Receive lead fees, referral fees, advertising fees, commissions, service fees, or other compensation.
  • Accept certain plumbing jobs directly.
  • Schedule, coordinate, manage, bill for, or supervise certain plumbing services.
  • Use employees, subcontractors, independent contractors, affiliates, or third-party providers to perform accepted work.

Aiken SC Plumbers is therefore not necessarily a neutral or comprehensive directory. Some listings may be sponsored, featured, affiliated, paid, or connected to a lead-purchase, advertising, referral, subcontracting, or service arrangement.

Submitting a service request does not guarantee that a provider will be available, that a provider will accept the work, that you will receive a quote, or that an appointment will be confirmed.

2. Directory and Referral Services

When we provide your information to an independently operated plumbing company or plumber, that provider—not Aiken SC Plumbers—is generally responsible for:

  • Reviewing the requested work.
  • Contacting you.
  • Providing or confirming an estimate.
  • Determining availability.
  • Verifying licensing and insurance requirements.
  • Obtaining permits when required.
  • Entering into a service agreement with you.
  • Supplying labor, equipment, and materials.
  • Performing and supervising the work.
  • Complying with applicable codes and laws.
  • Collecting payment.
  • Handling warranties, cancellations, refunds, complaints, and damage claims related to its work.

Unless we expressly state otherwise in writing, an independently listed or referred provider is not our employee, agent, partner, franchisee, or representative.

We may assist with communications between you and an independent provider, but we do not guarantee that a dispute will be resolved or that a provider will provide a refund, repair, warranty service, or other remedy.

3. Directly Arranged Plumbing Services

For some requests, Aiken SC Plumbers may directly accept, arrange, schedule, coordinate, supervise, or bill for plumbing services.

We may use:

  • Our own employees.
  • Licensed subcontractors.
  • Independent plumbing professionals.
  • Affiliated plumbing companies.
  • Other qualified service providers.

The use of a subcontractor does not necessarily mean that the customer has contracted directly with that subcontractor. Your booking confirmation, written estimate, invoice, work order, or service agreement will identify the party accepting responsibility for the particular job.

When Aiken SC Plumbers directly accepts a job, additional terms may be included in the:

  • Written estimate.
  • Booking confirmation.
  • Work order.
  • Change order.
  • Invoice.
  • Warranty.
  • Cancellation policy.
  • Other service-specific agreement.

Those service-specific terms supplement these Terms. When a service-specific written agreement directly conflicts with these Terms regarding a particular job, the service-specific agreement will control for that job.

We may decide whether to handle a request directly or refer it to another provider.

4. No Representation of a Physical Office

Aiken SC Plumbers serves customers seeking plumbing services in Aiken, South Carolina, and surrounding areas.

The use of “Aiken” or “Aiken SC” in our website name identifies the primary market or service area. It does not necessarily mean that:

  • We maintain a walk-in office within the City of Aiken.
  • Every listed provider is physically headquartered in Aiken.
  • Every provider serves every location surrounding Aiken.
  • A provider is available at all times.

Our current business mailing address and contact information are provided in the Contact Information section of these Terms.

5. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to submit a service request or book plumbing services.

By using the website, you represent that:

  • You are at least 18 years old.
  • The information you provide is truthful and accurate.
  • You have authority to request work at the identified property.
  • You have permission from the property owner when required.
  • Your use of the website complies with applicable law.

6. Service Requests and Lead Information

When requesting plumbing services, you may be asked to provide information including:

  • Your name.
  • Email address.
  • Telephone number.
  • Service address.
  • Property type.
  • Description of the plumbing issue.
  • Photographs or videos.
  • Preferred appointment date.
  • Information about water, sewer, drain, fixture, appliance, or piping conditions.
  • Property-access instructions.
  • Other information relevant to the requested service.

You agree to provide complete and accurate information.

You must not:

  • Submit another person’s contact information without authorization.
  • Impersonate another person.
  • Submit a fictitious or fraudulent request.
  • Misrepresent property ownership or access authority.
  • Conceal a known dangerous condition.
  • Use the request form to solicit, harass, or deceive providers.

We may reject, suspend, or close any request that appears fraudulent, unsafe, abusive, incomplete, outside the service area, or otherwise unsuitable.

By submitting a plumbing-service request, you authorize Aiken SC Plumbers to use the information you provide to respond to the request and help arrange plumbing services.

You further authorize us to disclose, sell, license, assign, distribute, or otherwise transfer the request and related information to one or more selected:

  • Plumbers.
  • Plumbing companies.
  • Contractors.
  • Subcontractors.
  • Affiliates.
  • Scheduling providers.
  • Customer-service providers.
  • Other businesses capable of responding to or fulfilling the request.

Information transferred as part of a lead may include:

  • Your name.
  • Telephone number.
  • Email address.
  • Service address or ZIP code.
  • Description of the plumbing problem.
  • Property details.
  • Preferred appointment information.
  • Photographs or videos.
  • Budget or estimate information.
  • Other details you included in the request.

Providers receiving your request may contact you directly and may maintain their own records regarding the request.

We may receive compensation for transferring a lead regardless of whether you hire the provider.

Submission of a request does not guarantee that:

  • Only one provider will receive the request.
  • A provider will respond.
  • A provider will accept the job.
  • A provider will offer a particular price.
  • A provider will be immediately available.
  • Aiken SC Plumbers will directly perform or manage the work.

Our handling of personal information is also governed by our Privacy Policy.

8. Telephone, Text Message, and Email Communications

By providing your telephone number or email address, you authorize Aiken SC Plumbers and the selected providers receiving your request to contact you concerning that request.

Communications may include:

  • Questions about the plumbing issue.
  • Requests for photographs or additional information.
  • Quote or estimate information.
  • Scheduling communications.
  • Appointment reminders.
  • Arrival updates.
  • Service follow-ups.
  • Requests for feedback.
  • Related plumbing-service offers.

Communications may be made by telephone call, text message, email, or voicemail.

Where permitted by law and where any required consent has been obtained, communications may use automated dialing, automated messaging, prerecorded messages, or similar technology.

Consent to receive promotional or automated marketing communications is not a condition of purchasing services.

Message and data rates may apply. Message frequency may vary.

You may opt out of promotional text messages by replying STOP. You may unsubscribe from promotional emails through the unsubscribe link in the email.

Opting out of promotional communications does not prevent communications concerning:

  • An active request.
  • A scheduled appointment.
  • A transaction.
  • A payment.
  • A service problem.
  • A safety concern.
  • A legally required notice.

Any separate communication-consent disclosure displayed beside a website form is incorporated into these Terms.

9. Provider Listings and Verification

We attempt to publish useful directory information, but we do not guarantee that every listing is complete, current, accurate, or suitable for a particular project.

Unless a listing expressly states that a particular item has been verified, you should not assume that we have independently verified a provider’s:

  • Identity.
  • Business ownership.
  • Physical address.
  • Licensing.
  • Registration.
  • Insurance.
  • Bonding.
  • Certifications.
  • Experience.
  • Background checks.
  • Employee screening.
  • Pricing.
  • Availability.
  • Service area.
  • Customer references.
  • Workmanship.
  • Legal or disciplinary history.

A provider’s inclusion, ranking, placement, profile, badge, review score, or appearance on the website does not constitute a warranty or guarantee.

Customers should conduct their own reasonable evaluation before hiring an independently operated provider.

10. Licensing, Permits, and Code Compliance

Plumbing providers are responsible for maintaining all licenses, registrations, insurance, business authorizations, and qualifications required for the work they perform.

When we directly arrange plumbing services, we will assign the work to a provider authorized to perform that type of work as required by applicable law.

The provider responsible for the work will determine whether:

  • A plumbing permit is required.
  • An inspection is required.
  • A licensed plumber must perform or supervise the work.
  • A utility, municipality, property owner, homeowners association, landlord, or other party must provide approval.
  • Additional professionals or specialty contractors are required.

Unless expressly included in a written estimate, permit, inspection, engineering, utility, or governmental fees are not included in an initial quoted price.

Customers must not ask a provider to perform unpermitted, unlawful, unsafe, or code-noncompliant work.

11. Emergency Requests

AikenSCPlumbers.com is not an emergency-dispatch system, public-safety service, or guaranteed 24-hour response service.

Do not rely solely on an online form when a plumbing condition creates an immediate risk of:

  • Serious flooding.
  • Electrical contact with water.
  • Structural damage.
  • Sewage exposure.
  • Fire.
  • Gas leakage.
  • Personal injury.
  • Another urgent hazard.

When safe to do so, you may need to shut off the affected water supply, avoid contaminated areas, contact the applicable utility, or contact emergency services.

Submitting an online request does not guarantee immediate review or response.

12. Quotes and Estimates

Prices displayed on the website or discussed before the condition has been properly evaluated are estimates only unless expressly identified as a fixed written price.

A final price may depend on factors including:

  • The actual cause of the plumbing problem.
  • Accessibility of pipes, drains, fixtures, or equipment.
  • Property age and construction.
  • Code requirements.
  • Permit requirements.
  • Material and equipment costs.
  • After-hours or emergency scheduling.
  • Travel distance.
  • Existing damage.
  • Hidden leaks or corrosion.
  • Blockages.
  • Tree roots.
  • Collapsed or damaged piping.
  • The need to open walls, floors, ceilings, cabinets, or landscaping.
  • Additional work requested by the customer.
  • Inaccurate or incomplete information provided before arrival.

A service call or diagnostic charge may apply even when:

  • No repair is authorized.
  • The problem cannot be reproduced.
  • The customer declines the proposed work.
  • Specialized equipment or another professional is required.
  • The provider determines that the requested work is unsafe or outside its scope.

Any applicable service-call or diagnostic charge should be disclosed before the appointment is confirmed.

13. Change Orders and Additional Work

A provider may discover additional conditions after work begins.

When reasonably possible, additional work and pricing will be described to the customer before the additional work is performed.

Approval may be documented through:

  • A signed change order.
  • An electronic acceptance.
  • A text message.
  • An email.
  • A recorded telephone authorization where lawful.
  • Another written or recorded confirmation.

Emergency measures reasonably necessary to prevent immediate damage or create a safe condition may be taken when obtaining prior authorization is impracticable, but only to the extent permitted by the applicable service agreement and law.

14. Bookings, Payments, Deposits, and Cancellations

A service request is not a confirmed appointment until confirmation is provided by Aiken SC Plumbers or the provider responsible for the job.

When payment is collected by Aiken SC Plumbers, you agree to pay:

  • The approved service price.
  • Applicable taxes.
  • Authorized material costs.
  • Disclosed diagnostic or service-call charges.
  • Approved change orders.
  • Other clearly disclosed fees.

If you provide a payment method, you authorize charges that are clearly disclosed and approved in connection with the service.

A deposit may be required for:

  • Special-order materials.
  • Large projects.
  • Permit fees.
  • Equipment rentals.
  • Reserved labor.
  • Other disclosed project expenses.

Cancellation, rescheduling, deposit, no-access, and no-show policies may be presented during booking or in a service confirmation. Those policies become part of the applicable service agreement when you confirm the booking.

When you pay an independently operated provider directly, that provider’s payment, deposit, cancellation, and refund policies apply.

15. Property Access and Customer Responsibilities

You are responsible for providing safe and lawful access to the property at the scheduled time.

You agree to:

  • Provide accurate access instructions.
  • Obtain permission from the property owner, landlord, or responsible party.
  • Secure pets.
  • Identify damaged, fragile, or valuable property near the work area.
  • Disclose known plumbing, electrical, structural, gas, mold, sewage, asbestos, or environmental hazards.
  • Inform the provider of alarms, cameras, gates, lockboxes, or restricted areas.
  • Provide access to required water shutoffs, fixtures, panels, equipment, and work areas.
  • Remove personal property that prevents reasonable access.
  • Keep children, occupants, and animals away from active work areas.
  • Avoid interfering with tools, equipment, or ongoing work.

You are responsible for the accuracy of any lockbox code, alarm code, gate instruction, key instruction, or access information you provide.

Additional charges may apply if a provider cannot access the property, cannot reach the work area, or must return because access was not available as agreed.

16. Hidden and Preexisting Conditions

Plumbing work may reveal conditions that were concealed, inaccessible, or not reasonably observable before work began.

Examples include:

  • Corroded pipes.
  • Improper prior repairs.
  • Code violations.
  • Deteriorated valves.
  • Unsupported piping.
  • Hidden leaks.
  • Damaged subfloors.
  • Mold.
  • Rot.
  • Pest damage.
  • Collapsed drain lines.
  • Tree-root intrusion.
  • Asbestos-containing materials.
  • Lead-containing materials.
  • Defective fixtures or appliances.
  • Electrical or structural hazards.

Unless expressly included in a written agreement, the provider is not responsible for repairing unrelated hidden or preexisting conditions.

Additional work needed to address such conditions may require a revised estimate, change order, permit, specialist, or separate contractor.

17. Opening Walls, Floors, Cabinets, and Other Surfaces

Some plumbing repairs require access through walls, ceilings, floors, tile, cabinets, countertops, concrete, landscaping, or other finished surfaces.

Unless expressly included in the written scope of work:

  • Plumbing pricing may cover access opening but not finish restoration.
  • Drywall, painting, carpentry, flooring, tile, concrete, cabinet, landscaping, or decorative repairs may require another contractor.
  • Exact matching of existing finishes, materials, colors, patterns, or textures is not guaranteed.
  • The customer is responsible for understanding what restoration work is and is not included.

The written estimate or work order should identify known access and restoration responsibilities.

18. Customer-Supplied Fixtures and Materials

When a customer supplies a fixture, faucet, toilet, appliance, valve, part, or other material, the customer is responsible for confirming that it is:

  • The correct item.
  • Complete.
  • Undamaged.
  • Compatible with the property.
  • Approved for the intended use.
  • Compliant with applicable requirements.

A provider is not responsible for defects, missing parts, incompatibility, manufacturer delays, or warranty limitations associated with customer-supplied materials.

Additional labor or return-visit charges may apply when a customer-supplied item cannot be installed as expected.

19. Hazardous or Unsanitary Conditions

A provider may refuse, suspend, or stop work when conditions are unsafe, unlawful, materially different from those disclosed, or outside the provider’s qualifications.

Examples include:

  • Active gas leaks.
  • Electrical hazards.
  • Raw sewage.
  • Biohazards.
  • Hazardous chemicals.
  • Suspected asbestos or lead hazards.
  • Significant mold.
  • Structural instability.
  • Aggressive animals.
  • Unsecured weapons.
  • Illegal substances or activity.
  • Threatening, abusive, discriminatory, or sexually inappropriate conduct.
  • Unsafe confined spaces.
  • Lack of required utilities or ventilation.

A specialized remediation, restoration, environmental, electrical, structural, septic, excavation, or other professional service may be required before plumbing work can continue.

20. Workmanship, Product Warranties, and Results

Any workmanship warranty offered for directly arranged services will be described in the applicable estimate, invoice, or warranty document.

Manufacturer warranties for fixtures, equipment, appliances, and materials are provided by the applicable manufacturer and may contain separate limitations and claim procedures.

Unless expressly stated in writing, we do not guarantee that:

  • A temporary repair will provide a permanent solution.
  • A drain will remain clear for a particular period.
  • An older plumbing system will not develop additional problems.
  • A repair to one component will prevent failure of another component.
  • Replacement materials will exactly match existing materials.
  • Every problem can be diagnosed without opening or testing part of the property.

A warranty may not apply when a problem results from:

  • Misuse.
  • Abuse.
  • Freezing.
  • Foreign objects.
  • Improper maintenance.
  • Unauthorized alterations.
  • Work performed by another person.
  • Manufacturer defects.
  • Preexisting conditions.
  • Normal wear.
  • Conditions excluded by the written warranty.

Nothing in these Terms eliminates rights or warranties that cannot legally be waived.

21. Damage and Service Complaints

Customers should report suspected damage, defective work, billing concerns, or other material service problems as soon as reasonably possible.

A report should include:

  • The customer’s name.
  • The property address.
  • The service date.
  • A description of the issue.
  • Photographs or videos when available.
  • Relevant receipts or records.
  • Other information reasonably necessary to investigate.

Customers should provide a reasonable opportunity to inspect an alleged defect or damage before arranging nonemergency corrective work by another provider.

Reporting an issue does not automatically guarantee a refund, replacement, reimbursement, or other compensation.

For work performed under a direct agreement with an independently operated provider, claims should generally be directed to that provider.

22. Reviews and User-Submitted Content

The website may allow users to submit reviews, ratings, photographs, comments, provider information, or other content.

You may submit content only when:

  • It reflects a genuine firsthand experience.
  • It is accurate to the best of your knowledge.
  • You have the right to submit it.
  • It does not violate another person’s privacy or intellectual-property rights.
  • It is not fraudulent, defamatory, threatening, discriminatory, obscene, or unlawful.

You must not:

  • Submit fake reviews.
  • Review a provider you did not use.
  • Impersonate another customer.
  • Coordinate reviews intended to manipulate ratings.
  • Submit reviews written by fictitious persons.
  • Threaten a negative review to obtain money or free services.
  • Offer or accept compensation conditioned on a particular review sentiment.

We may moderate, reject, restrict, or remove content that violates these Terms, contains private information, appears fraudulent, is unrelated to a firsthand experience, or creates legal or safety concerns.

By submitting content, you grant Aiken SC Plumbers a nonexclusive, worldwide, royalty-free license to store, reproduce, format, display, distribute, and use that content in connection with operating and promoting the website.

23. Provider Listings and Accounts

Providers may be permitted to create accounts, claim listings, update profiles, purchase advertising, or receive service requests.

Providers agree that all information they submit will be truthful, current, and not misleading.

Providers must not falsely claim:

  • Licensing.
  • Insurance.
  • Bonding.
  • Certifications.
  • Experience.
  • Awards.
  • Background checks.
  • Physical locations.
  • Employees.
  • Reviews.
  • Affiliations.
  • Availability.

Providers are responsible for complying with laws applicable to their businesses, workers, communications, advertising, taxes, insurance, licensing, permits, and services.

We may suspend, modify, reject, or remove a listing that appears inaccurate, deceptive, inactive, unsafe, unlawful, or inconsistent with our policies.

Providers may pay for:

  • Sponsored placement.
  • Featured listings.
  • Advertising.
  • Leads.
  • Referrals.
  • Enhanced profiles.
  • Exclusive or preferred service areas.
  • Other promotional benefits.

Compensation may affect where or how a provider appears on the website.

We may receive compensation whether or not the customer ultimately hires the provider.

Unless expressly disclosed, customers are not charged a separate directory fee merely for submitting a service request.

25. Acceptable Use

You may not use the website to:

  • Submit fraudulent service requests.
  • Harass customers, providers, employees, or contractors.
  • Scrape or copy directory information using automated tools.
  • Collect information for unauthorized solicitation.
  • Upload malware or harmful code.
  • Interfere with website operation or security.
  • Attempt unauthorized access to accounts or systems.
  • Misrepresent your identity or affiliation.
  • Manipulate listings, reviews, rankings, forms, inquiries, or analytics.
  • Infringe intellectual-property rights.
  • Use the website for illegal or discriminatory activity.
  • Reverse engineer protected portions of the website.
  • Resell leads or directory information without written authorization.

We may restrict access, close requests, remove content, suspend listings, or take other reasonable action when these Terms are violated.

26. Intellectual Property

The website and its original content—including its branding, design, text, graphics, logos, directory structure, software, service descriptions, and compilation of information—are owned by or licensed to Aiken SC Plumbers and are protected by applicable intellectual-property laws.

You may use the website for personal, noncommercial purposes related to finding or requesting plumbing services.

You may not copy, republish, sell, license, scrape, distribute, modify, or commercially exploit protected website content without prior written permission.

Names, trademarks, photographs, and content belonging to listed providers remain the property of their respective owners.

27. Third-Party Websites and Services

The website may contain links to:

  • Provider websites.
  • Social-media accounts.
  • Map services.
  • Payment processors.
  • Scheduling systems.
  • Advertisements.
  • Other third-party websites or services.

We do not control and are not responsible for third-party content, privacy practices, security, availability, pricing, representations, or conduct.

Your use of a third-party service is governed by that party’s terms and policies.

28. Disclaimer of Warranties

To the fullest extent permitted by law, the website and directory services are provided on an “as is” and “as available” basis.

We do not warrant that:

  • The website will always be available or error-free.
  • Every listing will be complete or current.
  • A provider will respond to a request.
  • A provider will be suitable for a particular job.
  • A quote will be the lowest available price.
  • A repair will achieve a particular result unless guaranteed in writing.
  • Website communications will be uninterrupted or completely secure.
  • Independently operated providers will meet every customer expectation.

Nothing in this section excludes warranties or consumer protections that cannot legally be disclaimed.

29. Limitation of Liability

To the fullest extent permitted by law, Aiken SC Plumbers and its owners, officers, employees, affiliates, contractors, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from:

  • Use of the website.
  • A directory listing.
  • A lead or referral.
  • The conduct of an independent provider.
  • A missed or delayed appointment.
  • Website interruption.
  • Loss of data.
  • Lost profits.
  • Property downtime.
  • A customer’s failure to take reasonable emergency precautions.

For a claim arising solely from directory or referral services, our total liability will not exceed the greater of:

  • The amount you paid directly to Aiken SC Plumbers for the directory or referral service giving rise to the claim; or
  • One hundred dollars.

For a claim arising from plumbing services directly sold by Aiken SC Plumbers, our total contractual liability will not exceed the amount paid for the specific service giving rise to the claim, unless a different limitation is stated in the applicable service agreement or the limitation is prohibited by law.

These limitations do not apply to liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other conduct for which limitation is prohibited.

30. Indemnification

To the extent permitted by law, you agree to indemnify and hold Aiken SC Plumbers and its owners, officers, employees, affiliates, and representatives harmless from third-party claims, losses, liabilities, and reasonable expenses resulting from:

  • Your fraudulent or unlawful use of the website.
  • Information or content you submit.
  • Your violation of another person’s rights.
  • Your violation of these Terms.
  • Unsafe conditions you knowingly failed to disclose.
  • Your lack of authority to request access to or work at a property.

This provision does not require you to indemnify Aiken SC Plumbers for its own unlawful conduct, negligence where indemnification is prohibited, or willful misconduct.

31. Privacy

Our Privacy Policy explains how we collect, use, retain, protect, sell, transfer, and disclose personal information.

The Privacy Policy is incorporated into these Terms by reference.

When there is a conflict concerning the handling of personal information, the Privacy Policy controls.

32. Electronic Communications and Signatures

You agree that website submissions, electronic acceptances, text messages, emails, digital signatures, and electronic confirmations may satisfy requirements that communications or agreements be in writing, to the extent permitted by law.

You are responsible for maintaining current contact information while you have an active request or booking.

33. Suspension and Termination

We may suspend or terminate website access, close a request, remove content, or deactivate a provider listing when reasonably necessary to:

  • Enforce these Terms.
  • Protect customers, providers, workers, or property.
  • Prevent fraud or abuse.
  • Address security or legal concerns.
  • Respond to suspected unlawful activity.
  • Discontinue a service.

Sections that by their nature should survive termination will remain effective, including intellectual-property, disclaimer, liability, indemnification, privacy, and dispute provisions.

34. Changes to These Terms

We may modify the website, business model, service area, features, or these Terms.

When material changes are made, we will update the effective date and post the revised Terms on the website.

Changes apply prospectively from the updated effective date. Continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms.

35. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.

Before filing a lawsuit concerning these Terms, the parties agree to make a reasonable, good-faith effort to resolve the dispute informally.

A written dispute notice should identify:

  • The person raising the dispute.
  • The relevant service or transaction.
  • The facts supporting the dispute.
  • The requested resolution.

If the dispute cannot be resolved informally, a legal proceeding must be brought in a state or federal court having jurisdiction over Aiken County, South Carolina, unless applicable law requires another forum.

Either party may bring an eligible claim in small claims court.

Nothing in this section prevents a party from seeking emergency injunctive relief or submitting a complaint to an appropriate government agency.

36. Severability

If a provision of these Terms is found unenforceable, that provision will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in effect.

37. No Waiver

A failure to enforce a provision of these Terms is not a waiver of that provision or of the right to enforce it later.

38. Assignment

You may not assign your rights or obligations under these Terms without our prior written consent.

We may assign these Terms in connection with a merger, acquisition, sale of assets, reorganization, financing, or transfer of the website or business.

39. Entire Agreement

These Terms, the Privacy Policy, and any applicable estimate, booking confirmation, work order, change order, warranty, invoice, cancellation policy, provider agreement, or service-specific terms constitute the agreement concerning your use of the website and applicable services.
